Employment Law



This course is intended to serve as an overview of Employment Law. The course concentrates on individual employee rights, rather than collective bargaining, while focusing on some legal issues raised by collective bargaining from time to time throughout the course. About half the course is spent on Employment Discrimination, with particular focus on Title VII. The course covers the development of the employment at will rule, what constitutes an employer-employee relationship, screening and testing at the hiring stage, modifications to the at will rule including employee privacy and speech rights, health and other benefits, including issues raised by ERISA, family and medical leave, and workplace safety. Assignments for the course may include memos/briefs, pleadings, and other skills practice.
