Legal History



This course explores the relationship between law and other forms of social control; the origins of political and legal obligation; the ethical basis of law developed through different jurisprudential approaches; and the evolution of constitutional systems. In addition, the course traces the development of several areas of law in the United States from the late eighteenth century to recent times. The topics vary, but have included the formation of the American Constitution of 1787 and challenges to that system, the development of judicial review, the growth of executive power, changes in criminal law and penology, the history of legal education and the legal profession, conflict between statutory codification and common law adjudication, and an examination of slavery and personhood.
