Description

This course examines litigation and jurisprudential issues associated with a federal system of government and a corresponding dual system for dispute resolution. The primary focus throughout the course is the tension between federal and state jurisdiction. Issues such as the relationship between federal law and state and federal courts, and constitutional and prudential limitations on access to federal courts are examined.

Prerequisites:

Civil Procedure I and Civil Procedure II or Constitutional Law I and Constitutional Law II. (Constitutional Law II may be taken concurrently.)
