California Civil Procedure

Description

This course focuses on pretrial and trial procedures in the state courts of California. It emphasizes areas not ordinarily covered in Civil Procedure I and II and topics in which California differs from the federal model. Subjects include jurisdiction, selection of the judge, pleading, statutes of limitations, pre-judgment remedies such as attachment and preliminary injunctions, and methods for early disposition of cases.  The course also focuses on California’s discovery rules and the state’s class action procedures. Also discussed are the judicial arbitration program, how to obtain a trial by jury, how to recover costs and attorney fees, and how to achieve and enforce settlements.
