Comparative Criminal Procedure

This course takes up the critical issues of: search and seizure of persons and places; arrest; right to counsel; confessions; right to bail; trial by jury; double jeopardy; and cruel and unusual punishment. These issues will be analyzed under both Canadian and American laws of Constitutional Criminal Procedure. In particular, the course will use and compare provisions of Canada's Charter of Rights and Freedoms, and the U.S. Constitution's Bill of Rights.
